Brutal Legend developer countersues Activision

Double Fine productions, the developers behind the upcoming title Brutal Legend are countersuing Activision. Activision filed a suit against the developer in an attempt to prevent the release of Brutal Legend.
Double Fine’s suit claims that Activision’s action was filed specifically to damage their company and also states that Activision is engaged in unlawful business practises by trying to remove potential competition to Guitar Hero.
Activision at one point had publishing rights for Brutal Legend but apparently declined to keep the title when Vivendi merged with Activision last year. Activision’s suit claims that they never gave up publishing rights but Double Fine is attempting to get a judge to declare otherwise. Brutal Legend has been picked up by EA and is due for release sometime in October, pending the results of the lawsuits.
